Robert T. Szostak, Esquire served as Presenter and Author for Pennsylvania Bar Institute Medical Malpractice Update Seminar

Trial Attorney, Robert T. Szostak, Esquire, of Rubin, Glickman, Steinberg and Gifford, P.C., served as faculty for the Pennsylvania Bar Institute Medical Malpractice Update Seminar presented on March 21, 2013 in Philadelphia. Mr. Szostak also authored a comprehensive book chapter and PowerPoint Lecture updating the law on medical malpractice that was distributed statewide. His presentation covered significant developments involving the Doctrine of Corporate Negligence and Pennsylvania Supreme Court duty analysis, the "Error-in-Judgment" Jury Instruction, communications between attorney and expert witness under the Barrick Superior Court En Banc Opinion, E-Discovery issues, frivolous litigation rules, sanctions for violation of the Certificate of Merit Rules, expert witnesses cases, informed consent and battery developments, damages in Wrongful Death and Survival Actions with focus on death damages arising from the loss of a child, punitive damages issues, MCARE Act developments, important case law on negligent infliction of emotional distress, Wrongful Birth and Wrongful Life Action constitutionality, jurisdiction where the harm originated outside of Pennsylvania, learned treatise law, the Two Schools of Thought Doctrine and the significant pronouncement of the Supreme Court protecting the sanctity of the jury.

"2012 produced many cases on duty, experts and damages involving affirmation of basic precepts," said Mr. Szostak. "However, some very important new trails were blazed." Mr. Szostak emphasized that "in 2013, we must pay close attention to evolving law on the Doctrine of Corporate Negligence where trial courts must now determine, in the first instance, whether or not the corporate entity breached a duty of care, not whether the entity is just a hospital or similar to a hospital." Mr. Szostak cautioned that the "Error in Judgment" jury instruction is a key area of malpractice law to watch - "the Error in Judgment Jury Charge is an unwarranted carryover from the last century that serves no useful purpose when charging the jury on the applicable standard of care and causation." Over the course of his presentation, Mr. Szostak also encouraged the receptive and well-seasoned audience to follow developing law on communications between attorney and expert. "Until otherwise advised, a party may not discovery the communications between another party's attorney and any expert who is to be identified as a trial witness regardless of the form of the communications," said Szostak. November 2, 2012 - Robert T. Amy R. July 23, 2012 - Matthew Taylor Wilkov, Esquire served as a Presenter at the Pennsylvania Bar Association's 2012 Family Law Section Summer Meeting

Matthew Taylor Wilkov, a Partner at the Lansdale law firm of Rubin, Glickman, Steinberg and Gifford, P.C., and a current U.S. Army Reserve JAG Officer, served as the plenary presenter at the Pennsylvania Bar Association's 2012 Family Law Section Summer Meeting held in Hershey, Pennsylvania, July 12th through July 15th. His presentation opened the Conference and was entitled "What Family Law Attorneys Need to Know About Military Issues." He provided the 200+ family law attorneys in attendance with information on how to handle issues that arise in family law matters where one or both of the parties is in the military including jurisdictional issues, service of process issues, Servicemembers' Civil Relief Act issues, spousal and child support issues and the difficulties which arise in dividing, collecting and safeguarding the always-confusing military retirement.

Gregory R. November 4, 2008- Attorney Matthew Taylor Wilkov promoted to the rank of Lieutenant Colonel in the U.S. Army Reserve. September 12,2008 - Attorney Matthew Taylor Wilkov presented a seminar at the Pennsylvania Bar Institute.

The course was also available via closed circuit television to attorneys from across the Commonwealth. At the request of the Pennsylvania Bar Institute, Mr. Wilkov presented a class entitled, "Family Law and the Military." August 7, 2008 - Attorney Robert T. Szostak spoke at Medical Malpractice Seminar

Attorney Robert T. Szostak, a member of the Lansdale law firm of Rubin, Glickman, Steinberg and Gifford, spoke at a seminar on July 23, 2008, entitled "The Brave New World of Medical Malpractice Litigation" presented by the Pennsylvania Bar Institute. Mr. Szostak specifically addressed how medical malpractice litigation has been reformed by the Pennsylvania Legislature, the Supreme Court and "the court of public opinion." Mr. Szostak explained the sustained statewide and local trends in reduction of claim frequency and severity. His presentation involved an overview of case investigation and screening, pragmatic considerations throughout the litigation process, the Rules of Civil Procedure, including the recent amendments to the Certificate of Merit Rules, fand a comprehensive update of the law on Certificate of Merit and expert witness issues. Mr. Szostak detailed the Mcare Act pertinent to patient safety, informed consent, punitive damages, modification of the collateral source rule involving past medical expenses and past lost earnings, payment of damages, future and other medical expenses, future loss of earning capacity changes, statutes of limitations and repose, ostensible agency, insurance modifications, preservation of records issues and basic legal precepts involving physician negligence, corporate liability and increased risk of harm theories, factual cause, and changes in the law on remittitur.

Mr. Szostak concentrates his practice in the area of Civil Litigation. For 20 years, he has represented victims of catastrophic medical negligence. He is considered among Pennsylvania's Super Lawyers in the field of medical malpractice. Mr. Szostak also handles insurance bad faith, fraud, defamation, products liability and other complex personal injury cases involving motor vehicles, amusement parks, construction accidents and premises liability. May 12, 2008 Robert T. Szostak Joins Rubin, Glickman, Steinberg and Gifford

Civil litigation attorney Bob Szostak joined the law firm of Rubin, Glickman, Steinberg and Gifford this spring with a plan: Continue building a legacy of leadership and success in the broad spectrum of civil litigation that includes medical malpractice, defamation, product liability and commercial matters with respected colleagues in a firm that is rapidly expanding its reputation for individual excellence in diverse areas of the law.
