Boy from Pennsylvania struck by allegedly drunk driver

A Pennsylvania boy is preparing for his fourth surgery in nearly a year. He was injured last year when he and his aunt were struck by an alleged drunk driver. The two were leaving a baseball game on Aug. 4 when a 22-year-old man behind the wheel of a Toyota Tundra struck the boy and his aunt as they were crossing the street.

The boy, 9 years old at the time of the drunk driving accident, was on vacation in another state at the time of the accident. He and his aunt had just left a Philadelphia Phillies game in that city.

The driver was stopped at his home an hour after the incident. Authorities determined that his blood alcohol content exceeded the legal limit of 0.08 percent and took him into custody. He has remained in the custody since August 2011 of last year and recently pleaded guilty to one count of DUI causing injury.

His sentence includes one year in county jail and five years of probation. The man will also have to perform 100 hours of community service by speaking to youths about the accident. He will also be required to pay restitution to the victims. His troubles will not end there if the boy's family decides to file a personal injury lawsuit.

According to the prosecutor's office, the man will receive credit for the time he has already spent in jail. He is expected to be released within the coming months.

The boy, after being injured in the crash, did not return home until the following month. His family, after hearing of the guilty plea, said that they were happy, adding that they believe this will help them move on with their lives.
