Budget director's wife to get probation for DUI, fleeing conviction

Georgina Zogby will avoid jail time and serve probation after being sentenced for a number of criminal offenses stemming from a drunken driving arrest in July 2011. The wife of Pennsylvania Budget Secretary Charles Zogby will spend three years on probation after being convicted for fleeing police and DUI.

The ordeal with state police began after she ran a stop sign, and lead to a 10-minute chase from Monroe Township into Silver Spring Township. Police were in pursuit with lights and sirens activated, and they finally used a strip spike to deflate Zogby's tires in order to stop her car.

Zogby's story underscores the importance of having an attorney present to make critical arguments about the effectiveness of probation instead of jail time. Fleeing police is a felony charge in Pennsylvania which is punishable with time in state prison. However, judges understand that some people (even though they have committed a criminal act) are better served by taking advantage of rehabilitative services that will help in getting their lives back on track.

Essentially, if the person is willing to take responsibility and follow the probation recommendations, they will avoid additional penalties and time behind bars.

Probation is commonly offered to non-violent offenders, but not everyone will qualify. Judges must make decisions based on a person's criminal history and balance the public's safety interest against the offender's likelihood of completing the probation requirements.
