Fewer drunk driving arrests reported

While the New Year's parties have ended and people settle into normal life in 2013, we look back on trends for drunk driving arrests. While final statistics are still coming in for the recent holiday season, it appears that DUI arrests are trending down. According to a report by the American Automobile Association (AAA) there were fewer DUI arrests in 2011 in Pennsylvania (50,413) compared to 2010 (52,000).

There was no hard evidence suggesting that those numbers would increase for 2012, but the combination of additional information, job losses and increased expense in dealing with drunk driving charges could lead to the decrease in arrests. Regardless of the actual contributors, the trend was a positive omen going into the holiday weekend, as New Year's is traditionally the deadliest holiday of the year.

Nevertheless, some drivers will be stopped and arrested on suspicion of drunk driving. When this happens, having an experienced criminal defense attorney is important in two respects.

First, a lawyer can challenge the story presented in the officer's report. Whether there are subtle (or stark) differences in your story and the arresting officer's, an attorney can discover these differences and use them to your advantage.

Also, you have a constitutional right to legal counsel when charged with a crime. Many people know their Miranda rights because they have heard them on police dramas. (i.e. the right to remain silent, that anything you say can be used against you in court, and the right to have an attorney). These are very important rights that should not be forfeited when you face the a lawyer.
