Preliminary Hearing -- The Tee Shot

Every criminal case in Montgomery and Bucks Counties starts out with a Preliminary Hearing.  When I use the words "start out," I mean that to say this is the first critical stage where a good lawyer starts to shape how the case will finish.  As I tell my clients, the Preliminary Hearing in a criminal case is just like a Tee Shot in the game of Golf.

Although not everyone knows the game of golf, everyone generally gets the idea that you hit a ball with a club, with the object of causing the ball to fall into a hole with the fewest strokes.  The first stroke is called the Tee Shot.  The tee shot is hit with a driver (the big club), and the object of the Tee Shot is to hit the ball far down the fairway to set up a good score.  The worst thing that can happen on a Tee Shot is to flub the shot, or slice the ball off into the trees.  Then, it takes a lot more work to get to the hole.

In criminal court, the Preliminary Hearing is the Tee Shot.  Screw up the Preliminary Hearing, you've screwed up the case.  Fail to get charges dismissed, then all the charges go to trial. 

Some people come to see me after they tried to take the Tee Shot themselves and slammed the ball off into the woods... and by that I mean they handled the Preliminary Hearing themselves... often to save money.  However, they usually wind up paying more, given it will take me numerous swings to get them out of the woods...

Yesterday, in Souderton, I turned 115 counts of misdemeanor theft into a non-traffic citation.  Case closed.  No jail.  No probation.  Hole in one.  That would not have happened without me.

In the same court in Souderton, my partner Greg Gifford got serious gun charges dismissed.  Case closed.  No jail.  No probation.  Perfect Tee Shot. 

Our clients could have represented themselves at their hearings, but they would have messed up their Tee Shots. 

Simply put, don't try to take your own Tee Shots in Souderton, New Britain, Montgomeryville, Schwenksville, Whitpain, Lansdale, Quakertown, Newtown, Warminster, Jamison.... or in any of the Magisterial District Courts in Montgomery or Bucks Counties... or you'll wind up in the woods.  Feel free to give me a call if you are facing criminal charges in the counties, I've been perfecting my Tee Shots for nearly 20 years...
