According to police, a 42-year-old water tank truck driver was traveling south on Route 88 at Eighty-Eight Road when he lost control of his vehicle on a right-hand curve. He allegedly veered into the northbound lane, rolled onto the driver’s side, struck a Nissan and then rolled over a hillside before hitting a garage. The 42-year-old driver was killed, and the female driver of the Nissan suffered moderate injuries. She was flown via helicopter to Allegheny General Hospital where she received treatment.
After a truck accident in Pennsylvania involving injuries as this one did, it might be difficult to construct a clear picture of liability. An attorney may be able to use the results of a completed accident investigation or other evidence such as traffic camera footage to pinpoint all liable parties. That attorney could assist an accident victim by pursuing compensation for medical bills, lost wages, and pain and suffering as well as other hardships.
In this case, the truck driver may be deemed liable if it can be proven that he would have been able to take evasive action had he not been negligent in some way. An attorney representing an injured plaintiff could file a lawsuit against the tanker truck company and call upon experts in accident reconstruction and truck maintenance to argue a case. Other factors that may be important are improper loading or unloading, speeding or reckless driving, and driver fatigue and drug or alcohol abuse.
