What Constitutes Sexual Abuse of a Child under Pennsylvania Law?

Sexual abuse of a child is a felony charge in Pennsylvania. The grading of each felony charge for sexual abuse of a child is defined under 18 Pa. Cons. Stat. § 6312 as the following:

  • Second Degree Felony: Photographing, videotaping, depicting on a computer, or filming sexual acts, or permitting a child under 18 to engage in these acts is a felony of the second degree.
  • Second Degree Felony: Child pornography, or the intentional viewing, possessing, or controlling of any material depicting a child under 18, is a felony in the second degree.
  • Third Degree Felony: Selling, transferring, delivering, or displaying photographs, videotapes, computer depictions, and films of a child under 18 is a felony of the third degree.
