Notably, there is no mandatory license suspension for first-time offenders in this tier, which is a significant distinction from higher tiers.
High BAC (BAC 0.10% to 0.159%)
The High BAC tier carries more serious consequences, even for first-time offenders. A conviction at this level can result in 48 hours to six months in jail, fines ranging from $500 to $5,000, a 12-month license suspension, and mandatory alcohol highway safety school. According to Pennsylvania’s DUI statute (75 Pa.C.S. § 3804), the mandatory minimum jail time at this tier applies even without a prior record, which is why this charge demands immediate legal attention. Drivers may also be required to complete a treatment program before license reinstatement.
Highest BAC (BAC 0.16% or Higher) and Controlled Substances
First-time offenders in the Highest BAC tier face the steepest consequences available to someone with no prior DUI history. Penalties include a mandatory minimum of 72 hours in jail, up to six months of incarceration, fines between $1,000 and $5,000, and a 12-month license suspension.
